What is a reasonable accommodation in MDSP’s program?

A reasonable accommodation is a change or modification to afford a qualified
individual with a disability full enjoyment of MDSP programs or activities, unless
modifications of policies, practices, and procedures would fundamentally alter the
nature of the program, service, or activity, or result in undue financial and administrative burdens to MDSP.

How do I request a reasonable accommodation?

Does my request for a reasonable accommodation need to be in writing?

No, you do not need to put your request in writing, however, making a written request can be helpful documentation for ensuring that MDSP provides the desired accommodation. In addition, you do not need to use the specific words “reasonable accommodations” when making your request.

When should I request a reasonable accommodation?

You may request a reasonable accommodation from MDSP at any time. However, making the request in advance of a meeting, conference call, or visit will help ensure that MDSP is able to fulfill the request for an accommodation.For certain requests, such as requests for sign language interpretation, MDSP requests at least two week’s advance notice.

May someone request a reasonable accommodation on my behalf?

Yes, anyone can request a reasonable accommodation on behalf of an individual with a disability who seeks to interact with MDSP staff or participate in its programs or activities.

What will MDSP do upon receiving my request for a reasonable accommodation?

MDSP may contact you to obtain more information about your request and to better understand your needs. In addition, MDSP may review your request to determine:

• Whether the requested accommodation will be effective in allowing you to participate in the activity or program in which you are seeking participation;

• Whether the requested accommodation is reasonable, or an equally effective alternative to the requested accommodation is available; and
• Whether providing you with the requested accommodation would fundamentally alter the nature of MDSP’s program or impose unduefinancial or administrative burdens on MDSP.

In addition, in some cases, MDSP may consult with you in an interactive process to determine on a case-by-case basis what accommodations can be made.

If MDSP determines that your requested accommodation would fundamentally alter the nature of the program or impose an undue financial or administrative burden, MDSP may deny your request. However, in the unlikely event that this occurs, MDSP will work with you to identify an alternative accommodation that allows you to effectively participate in MDSP’s program, activity, or service.

May MDSP request medical documentation from you after receiving your request for a reasonable accommodation?

No, MDSP may not request medical documentation after receiving your request for a reasonable accommodation. MDSP questions will be limited to understanding thebarrier to your ability to participate in the program or activity in which you are interested and the nature of an accommodation that will remove this barrier.

May MDSP charge you the cost of providing the reasonable accommodation?

No, you are not responsible for the cost of an auxiliary aid or service MDSP provides to you.

What are some examples of reasonable accommodations?

There are many types of reasonable accommodations. Some examples of how MDSP provides reasonable accommodations include:
• Arranging for qualified sign language interpreters
• Providing on-site captioning
• Producing alternate formats of print materials in braille, large print, or in an electronic format
• Providing remote conference captioning services
• Furnishing a temporary ramp to access the dais or other areas with one or more stairs to ensure accessibility for individuals who have physical disabilities and may be using a wheelchair or walker.

AVIATION COMMAND

If you fly me to the hospital, will I receive a bill?

No, the Maryland State Police Aviation Command does not bill patients.

Who provides funding for the Aviation Command?

The Aviation Command is financed through the Maryland Emergency Medical System Operations Fund (MEMSOF) and Maryland's General Fund. The MEMSOF is funded through a small surcharge during motor vehicle registration. Approximately 80% of our helicopter operations are funded through the MEMSOF.

How many helicopters does the Maryland State Police have?

We currently operate 10 helicopters and staff 7 sections. "Extra" helicopters are needed as they require frequent routine maintenance that will take them out of service for periods of time.

When you pick up someone who is injured, where do you take them?

The majority of our patients were involved in some form of trauma. We typically transport patients to trauma-receiving facilities. Although many people are familiar with the to certified "Trauma Centers" throughout the state. Although many people are familiar with the University of Maryland Shock Trauma Center, there are other Trauma Centers as well. For example, pediatric trauma patients are usually transported to either Johns Hopkins Hospital or Childrens National Medical Center in Washington, DC. The destination of a medical patient we transport will depend on the type of emergency they are experiencing.

BULLET PROOF BODY ARMOR

Who needs to apply to use, possess or purchase bullet proof body armor?

Only individuals with a prior conviction for a crime of violence or a drug trafficking crime as defined in the statutes.

What is considered a crime of violence?

Crime of violence has the meaning stated in Criminal Law Article, 14-101, Annotated Code of Maryland.

What is considered a drug trafficking crime?

Drug trafficking crime has the meaning stated in Criminal Law Article, 5-621, Annotated Code of Maryland.

CAN A TROOPER...

Can a Trooper stop me if he is driving an unmarked car?

Yes. Police vehicles must activate a siren to be an emergency vehicle and may or may not display red or blue lights. Most unmarked Maryland State Police vehicles display at least one blue flashing light. If you feel uncomfortable pulling over, acknowledge to the vehicle that you are aware that they are trying to pull you over by waving and slow down. Drive to a well lit area where people are. If you have a cell phone dial #77 and this will connect you with the nearest Maryland State Police barrack. Advise the dispatcher that you are uncomfortable with the situation and the dispatcher will assist you.

Can a Trooper drive a marked Maryland State Police car in plain clothes?

Yes.

Can a Trooper pull me over for no reason?

No. Any law enforcement officer needs a reason (probable cause) to stop a vehicle.

Can a Trooper issue me a citation without showing me the radar or laser gun he used to obtain my speed?

Yes. There is no rule that requires that a Trooper show you the radar or laser gun.

Can a Trooper force me to sign a citation?

No, you can't be forced. However, at that point, you are subject to arrest. And remember, signing a citation only acknowledges that you received the citation, not that you admit guilt.

Can a Trooper disobey the speed limit?

Yes and no. If he is performing his duties, he may disregard traffic laws as long as he proceeds with due caution. Troopers cannot disregard traffic laws unless they have a reason.

Can a Trooper have a passenger in his State Police vehicle who is not another Trooper or prisoner?

Yes. Authorized passengers are permitted. The Maryland State Police has specific rules for who may or may not be a passenger in a Maryland State Police vehicle.

Can a Trooper pull me over if I am "going with the flow of traffic"?

Yes. There is no exemption from the speed laws bacause you are breaking the law with other people.

COMMERCIAL VEHICLES

What are Maryland's legal limitations regarding vehicle width, height, length, and load extensions?

There are too many to enumerate. Contact our Commercial Vehicle Enforcement Section or visit the State Highway Administration website to download the Maryland Motor Carrier Handbook.

How can a commercial vehicle driver obtain an oversize or overweight permit in Maryland?

CRIMINAL LAW

If I am legally stopped by a police officer on the street, can he search me?

You can be subject to a search upon arrest or a pat down if there is reasonable articurable suspicion that you have a weapon. Police can also ask your consent to be searched.

What happens if I refuse to sign a traffic ticket?

You are subject to arrest. When signing a citation you do not admit any guilt you are advising that you will comply with the requirements of the citation (appearing in court or paying the fine).

If I am questioned by a Trooper after being stopped on the street, do I have to answer his questions?

If you are walking on the street and you have not committed a crime then you do not have to answer questions. The police can ask you questions though.

How do I obtain a criminal warrant for someone?

Contact the District Court Commissioner in the jurisdiction where the crime occurred. They will have you fill out an application for charges that you will sign and swear to. If they feel that there is probable cause they can issue a warrant or a summons.

EMPLOYMENT VERIFICATION

How do I obtain employment verification with MSP?

Effective January 1, 2016, fax requests will not be honored

E-mail employment verification requests, along with the release authorization, to msp.hrd@maryland.gov. You will receive a response to your request within 72 hours.

FIREARMS

How do you become a gunsmith, retail or wholesale firearms dealer, or get information on ammunition sales and/or gunsmithing?

Please contact our Licensing Division for that information.

How can I legally transport firearms within / through Maryland?

They must be unloaded, in a carrying case, holster with a flap and the ammunition should be separate. It would be best to keep the unloaded weapon in the trunk where you do not have access to it. There are further regulations but essentially you can only transport a handgun between residence, to and from a repair shop, a shooting sporting event, between a residence and place of business if substantially owned and operated by the person. What handguns are approved for sale in Maryland?

Is there a law for storing firearms in the home?

Yes. Under the Maryland Annotated Code, Criminal Law, Article 4 Section 104, it is unlawful for any person to store or leave a loaded firearm in a location where the person knew or should have known that an unsupervised child would gain access to the firearm. (For safety purposes, the stored firearm should be unloaded and the use of a trigger lock is recommended).

Is an AK-47 handgun banned?

No, an AK-47 handgun is not banned because it is not an assault long gun. An AK-47 handgun would still be a "regulated firearm" requiring a 77R and may not be sold in Maryland, or manufactured for distribution in Maryland, unless included on the Handgun Roster.

FIREARMS COLLECTORS

Do I get a card with my collector status?

No. You will receive a letter explaining that you have been granted the status of a “Designated Collector”. This status allows for multiple firearm purchases.

Am I licensed when I become a firearms collector?

No. A Firearms collector is a status granted to an individual by the Maryland State Police. This status allows the individual to purchase more than one firearm at a time. This status does not grant any additional privileges or expedite the processing time required for a regulated firearms purchase.

FIREARMS DEALERS

What do I do if I move to a new place of business? Do I keep my old license?

A dealer's license is not transferable. Prior to moving a place of business, a licensee shall inform the Secretary and surrender the dealer's license.

Based upon the legislation, is it 'defined' for the dealers what they must do exactly in order to notify transferees of the 72 hour requirement for lost/stolen regulated firearm?

The Public Safety Article, 5-146(a) states that the dealer/seller/transferor "shall notify the purchaser or recipient . . . ." The statute doesn't provide any further guidance. A response to question #23 on the newly revised 77R that the dealer did so is sufficient.

Can Maryland Regulated Firearms Dealers transfer Regulated firearms at gun shows?

Yes. COMAR 29.03.01.21 ("Transfer of Regulated Firearms Sold at Gun Shows") states:
"A. A seller or dealer may not transfer a regulated firearm sold from a table or fixed display at a gun show until the eighth day after the seller or dealer has forwarded the application to purchase or transfer a regulated firearm by certified mail or facsimile machine to the Secretary.
B. A dealer may conduct business at a gun show if:
(1) A legible photostatic copy of a valid Dealer's License is displayed prominently in public view as part of the display;
(2) All business conducted at a gun show is from a table or fixed display; and
(3) The dealer conducts business in compliance with Public Safety Article, Title 5, Subtitle 1, Annotated Code of Maryland."

Is there an HQL exemption for a dealer when he is considering transfers from his personal stock which could be a purchase not applicable for entry into the federal Acquisition and Disposal Book, but for personal use?

If the dealer is a sole proprietor, then business stock is also the dealer's personal property. No 77R or HQL is required if the dealer transfers a regulated firearm from dealer stock to personal collection. If the sole proprietor dealer wanted to buy a handgun directly for his personal possession (from a licensed dealer in MD), then the dealer would have to complete the 77R and have a HQL.

The new law expressly exempts Firearms manufacturers from the HQL. Firearm Manufacturers only account for approximately 10% of licensed Maryland dealers. Is there an exemption for firearms dealers from the HQL requirement?

The Public Safety Article 5-102(6) exempts dealers from all requirements of Title 5, Subtitle 1 of Public Safety. Dealers can acquire handguns without an HQL for dealer stock. So, a dealer does not need an HQL to acquire stock. If the dealer is a corporation or LLC and it wants to sell a handgun to one of its employees or corporate officers, the purchaser will need to complete a 77R and have a HQL. If the dealer is a sole proprietor, then the business stock is also their personal property and no 77R/HQL would be necessary for transfers from "business stock" to "personal collection.

What if the applicant is a corporation?

If the applicant is a corporation, the application shall be completed and executed by a corporate officer who is a resident of the State of Maryland.

May I build my lower receiver purchased at any time into a handgun?

Yes, a lower receiver of a banned assault long gun may be manufactured provided there is compliance with federal and other state laws—into a handgun.

May I build my lower receiver purchased after 10/1/2013 into an assault long gun?

No, a lower receiver of a banned assault long gun purchased after 10/1/2013 may be built—provided there is compliance with federal and other state laws—only into a handgun, a short barreled rifle that has an overall length of 29 inches or greater, or if the lower receiver is an AR15 platform, into a heavy barrel model.

Do I need a Handgun Qualification License (HQL) in order to purchase a lower receiver?

No, a lower receiver of a banned assault long gun is classified by the State as a “firearm,” but not a “handgun”. A Handgun Qualification License (HQL) is only needed if you are purchasing a handgun that is not classified as a curio and relic.

Which code types should I use for section 4 of the 77R application?

For section 4 of the 77R application please utilize the code types below. We realize the current 77R application does not include the appropriate coding. The form has been corrected and will be disseminated upon reorder.

FIREARMS SAFETY ACT 2013 (SB 281)

If you already have an approved safety firearms training course, honorable military discharge, handgun carry permit, or lawfully own a regulated firearm - no new training course is necessary - correct?

If you have already taken a course approved by the Secretary, the answer is yes. Exemptions from the training requirement apply to someone who has taken the DNR Hunter Safety Course, is honorably discharged from the armed forces or National Guard, is an employee of an armored car company who has a handgun permit, or who lawfully owns a regulated firearm.

Does the new law require 16 hrs & 8 hrs (re-up) training for Conceal Carry Handgun permit holders?

16 hours of training is required for the initial issue of a handgun (carry) permit; 8 hours is required for the renewal of a handgun (carry) permit.

"Criminals" may not posses ammunition for regulated firearms - but how will a store know they are not selling ammunition to a criminal? Will I need a HQ license to buy ammunition for my regulated firearm?

Stores are not expected to know whether or not the person who purchases ammunition is prohibited. You will not need a license of any kind to purchase ammunition.

It appears that registration of "already owned" regulated/banned firearms, after 10/1/13 is no longer part of the law? Do owners need to register those rifles? Or register already owned (greater than 10 round) magazines?

Any firearm lawfully owned prior to October 1, 2013 is not required to be registered. Magazines are not required to be registered.

Is a folding stock a collapsible stock?

No.

Our team uses semi automatic AR10 or Heavy Barrel "H Bar" AR rifles in competitions - are they now part of the ban or considered regulated? They are not on the firearms list.

No, the AR-10 is not banned for sale in Maryland. The AR-10 is not one of the enumerated banned assault weapons as listed in the Public Safety Title 5 101 (r) (2). Please click here to find the Public Safety Article.

However, please note that an AR-10 could, depending on its specific configuration, meet the definition of a "copycat weapon" Criminal Law 4 301 (e)

Habitual drunkard is a person who has been found guilty of any three crimes under § 21-902(a), (b), or (c) of the Transportation Article, one of which occurred in the past year.

HANDGUN QUALIFICATION LICENSE

How do I apply for a Handgun Qualification License?

How will a firearms dealer know that I have a Handgun Qualification License?

The Maryland State Police will issue a Handgun Qualification License to present to the dealer.

How can I prove I legally owned a handgun before October 1, 2013 and am therefore exempt from the training requirement?

When applying for your HQL you will be asked for the serial number of your legally owned handgun. Upon providing that serial number you will have met your obligation.

Do I need an HQL to fire at a gun range?

No. An HQL is the only required to purchase, rent or transfer a firearm.

Will I be required to possess an HQL by October 1, 2013, if I submitted a 77R prior to October 1 and have not yet received approval to retrieve my firearm due to the MSP backlog?

The Maryland State Police will enforce the requirements of the new law with respect to applicants whose applications are pending as of October 1. In light of the number of currently pending applications, resulting from the unprecedented spike in new applications in recent months, it is a fair, reasoned, and appropriate result for those who are waiting for their pending purchase applications to be processed. Persons who submit purchase applications on or after October 1, 2013, unless otherwise exempted by law, will be required to apply for and obtain a handgun qualification license before attempting to purchase a handgun.

LAW ENFORCEMENT OFFICER SAFETY ACT (LEOSA)

How do I register for my EMDSP account and log on information?

From the licensing tab click on the LEOSA tab at the left of the screen. Go to the very bottom and click on the Law Enforcement Safety Act Online Link. This link will take you to all the online forms that require a EMDSP account. Go to the very bottom of the page and look for “If you have not registered, and are applying for the LEOSA Permit, please click here to register (or click theregister a person link on the left).” This will prompt you to create a log on name and password.

The online handgun permits application will not accept my valid email address in the appropriate space provided. What do I do?

You may hand write your email address if this occurs. Please make sure it is accurate and legible.

Who do I contact if I have any questions about the LEOSA application process?

Do I need to remember my log on name and password for future renewal applications?

Yes you will need to remember your log on and password for future renewal applications.

I don’t know which of the two or three numbers on my livescan receipt I’m supposed to put at the top of the application. Which number is the correct one?

You can leave that blank. Just make sure you send in your application with your livescan receipt.

When I type in my phone numbers the computer automatically puts a +1 in front of my number. I’m afraid the phone numbers will be wrong. Is this supposed to happen?

This is supposed to happen and is a software issue. No need to worry about your phone number being incorrect.

Do I need to carry my LEOSA identification card with me as well as my retired Maryland State Police credentials when wearing, carrying or transporting a handgun as a qualified LEOSA separated employee?

It is recommended that the L.E.O.S.A identification card be carried by the separated law enforcement officer along with his/her retired Maryland State Police credentials whenever the separated officer is wearing, carrying or transporting a handgun. However, the separated officer may carry a copy of his qualification score sheet signed issued by the MPCTC certified firearms instructor in lieu of the L.E.O.S.A identification card. In every case, the Maryland State Police credentials must be carried in conjunction with either the score sheet or the L.E.O.S.A identification card to be in compliance with federal law HR 218.

My country of birth is not listed in the drop down box. What should I do?

Can I renew my L.E.O.S.A. ID Card On-line?

LEOSA ID Cards issued by the Maryland State Police will be renewable on-line on or before January 1, 2014.

Does the Maryland State Police conduct fundraising activities?

The Maryland State Police do not, but employee groups such as the Fraternal Order of Police and the Maryland Troopers Association do.

How can I obtain a copy of my criminal record (or lack thereof) for employment purposes?

You must be fingerprinted to obtain your criminal record. Fingerprinting services at Maryland State Police barracks have been temporarily discontinued. The Department of Public Safety and Correctional Services website lists locations where fingerprinting services are available. Their website is dpscs.maryland.gov.

How do I obtain a criminal background check?

You must be fingerprinted to obtain your criminal record. For locations where this service is provided, go to the Department of Public Safety and Correctional Services website at dpscs.maryland.gov.

If I have questions about property I have lost, that has been found, what do I do?

First you must determine which police department has your property. Contact that police department or, if it is the State Police, contact your local barrack and ask for the property supervisor. This is usually the Detective Sergeant for the Maryland State Police.

How do I schedule a Trooper to speak at my school or civic event?

Contact your local state police barrack and ask for the duty officer. He will be able to help.

I am a police officer / trooper from another agency. Does the Maryland State Police accept lateral transfers?

No. All Maryland State Troopers must attend the complete Maryland State Police Academy.

I have seen Maryland State Troopers driving their patrol cars while off-duty. Are they permitted to do that?

Yes.

How can I purchase property that was seized by or turned in to the State Police?

The Maryland State Police Quartemaster Division holds property auctions regularly. Please check this website for upcoming auctions.

How do I obtain information about police-related training?

Does the Maryland State Police offer any kind of crime prevention/reduction service programs to the community?

Contact your local state police barrack and ask for the duty officer. He will be able to help.

Is there a citation quota for troopers?

No.

My vehicle was stored (impounded) by the State Police. How can I get it back?

Since circumstances of the storage may vary, you should contact the Barrack that stored the vehicle. They can advise you of the specific requirements to release your vehicle.

QUALIFIED HANDGUN INSTRUCTOR

How do instructors get a copy of the shooting course?

Instructors will be mailed a copy of the practical police and basic course. The can contact the Maryland State Police Handgun Permit Section by email if they need another copy (msp.handgunpermits@maryland.gov).

How will instructors notify the Maryland State Police that they have certified a student?

The Maryland State Police is aggressively automating many licensing services. The Handgun Qualification License will be automated and the reporting of the training requirement will be communicated to instructors prior to October 1, 2013.

If I am not certified by MD Police & Correctional Training Commission or have a valid certification issued by a nationally recognized firearms organization, how can I be approved to instruct Handgun Qualification License and Wear & Carry Permit applicants

A Qualified Handgun Instructor License should be completed online through MyLicense and submitted. The application should include:
1. The applicant’s name, address, driver’s license or photographic identification soundex number, Social Security number, place and date of birth, height, weight, race, sex, eye and hair color, occupation, and home and work telephone numbers;
2. Proof of the applicant’s formal training in the care, safety, and use of handguns, including a minimum qualification score of 80 percent on a practical police course; and
3. Proof of the applicant’s minimum of 1 year of experience in instruction in the care, safety, and use of handguns.
4. Upon receipt of a properly completed application, the Secretary shall issue a Qualified Handgun Instructor License to the applicant within a reasonable time.

5. A Qualified Handgun Instructor License expires 4 years from the date of issuance.

When does the Qualified Handgun Instructor License expire?

The Qualified Handgun Instructor License is valid for 4 years from the date of issuance.

How do instructors get the course information?

Instructors will be responsible for the specific course and will attest/certify that they instructed the minimum criteria required in SB281.

If I am certified by the MD Police & Correctional Training Commissions or have a valid certification issued by a nationally recognized firearms organization, how can I be approved to instruct Handgun Qualification License & Wear & Carry Permit applicants?

A Qualified Handgun Instructor Certificate should be completed online through MyLicense and submitted. The application should include:
1. The applicant’s name, address, driver’s license or photographic identification soundex number, Social Security number, place and date of birth, height, weight, race, sex, eye and hair color, occupation, and home and work telephone numbers;
2. A valid copy of the applicants Maryland Police and Correctional Training Commission certificate; or a copy of a valid instructor certification card issued by a nationally recognized firearms organization.
3. A Qualified Handgun Instructor Certificate uses the expiration date that is supplied on the supporting documentation that is provided by the applicant for this process. i.e. a Maryland Police and Correctional Training Commission Certified Instructor whose credentials would expire on 12/31/2015 would have their Qualified Handgun Instructor Certificate expire on 12/31/2015.

REGULATED FIREARMS PURCHASES

Can I complete an additional application for the purchase of a regulated firearm even though I am currently waiting for my previous application to be approved?

A person may not purchase more than one regulated firearm in a 30-Day period. You may complete more than one application within 30 days, however you may not transfer or take possession of more than one firearm within the 30 day period. Exceptions to this rule are listed on the Regulated Firearms Collector page.

The Maryland State Police recently confirmed my eligibility and I purchased a handgun last month. Why am I on review again?

Even though you have recently purchased a handgun legally, a background check is still required. MSP must ensure that since the time of your purchase you have not been served a protective order, or been arrested, convicted of a disqualifying crime, or placed on supervised probation, etc.

Can you check my record prior to filling out the paperwork for a regulated firearm?

No, Maryland law does not allow the Maryland State Police to access your criminal record without first having an application on file.

What is a habitual drunkard?

Habitual drunkard is a person who has been found guilty of any three crimes under § 21-902(a), (b), or (c) of the Transportation Article, one of which occurred in the past year.

What is a habitual user?

Habitual user is a person who has been found guilty of two controlled dangerous substance crimes, one of which occurred in the past 5 years.

Why am I placed on review?

If there are any discrepancies discovered on the 77R application and/or during any records checks, the application will be placed on hold pending further review by a Maryland State Trooper to ensure the applicant is not prohibited from possessing a regulated firearm.

Are Residential Sprinklers The Sole Answer To Maryland's Fire Problems?

No. There is no one single cure for Maryland's Fire and burn problem. There are, however, several things that can be done to make our State a more fire safe place to live, work and play. Here are some of the tips that may help stop a fire from starting or help you to survive one should it occur.

If you must smoke, don't smoke in bed.
Install and maintain Smoke Detectors in your home. Remember - smoke detectors are now required in every dwelling by Maryland Law.
Plan and practice Exit Drills In The Home with your family. Make sure everyone knows two ways out.
If you get caught in smoke DO NOT panic. Stay low to the floor where the air is better and crawl to a clear exit.

What Are Residential Sprinkler Systems?

With newly designed sprinklers and standard household piping, homes can now be built or even remodeled to include low-cost automatic residential sprinkler systems connected to a domestic water supply.Residential sprinklers are designed to respond to a fire much faster than currently available standard commercial or industrial sprinkler systems. These new residential sprinklers react automatically to fire -- nearly five times faster than standard sprinklers.There are many advantages of using residential sprinklers. For example:

Residential sprinkler systems offer a low cost reliable safety option that attracts many home buyers.
Residential sprinklers will either extinguish a fire or control it until the arrival of the fire department.
Residential sprinkler systems help to eliminate flame and smoke by controlling a fire quickly. This in turn reduces the danger of burn injuries and the build up of deadly carbon monoxide poisoning.
Residential sprinkler systems can be installed in a home for approximately $1.00 per square foot. In some instances the cost is even less.
Residential sprinklers allow the use of alternative building design and construction materials - which can significantly off set the cost of sprinklers.

What Kind of Record Do Sprinklers Have?

Excluding those deaths caused by explosion or flash fires, there are no known occurrences of multiple loss of life in a fully sprinklered building due to smoke or fire.

Residential sprinklers help to save lives and reduce property damage because sprinklers are designed to operate in the area of fire origin. Normally, only the sprinkler that is closest to the fire will activate. Statistics have shown, that in residential fire situations, usually one sprinkler can control a developing fire.

Families with children, senior citizens, and handicapped individuals have turned to residential sprinklers to provide them with added fire protection.

Tests of new residential quick-response sprinkler systems, designed for use in single-family homes and multi-family dwellings, in typical home fire scenarios, revealed that the sprinklers responded in as little as 35 seconds completely extinguishing the fires.

TRANSPORTING FIREARMS

Can we travel to other states for competitions and return with our already owned banned firearms? Can someone come from another state, for competition in Maryland, with a banned rifle?

A Maryland resident who lawfully owned the firearm prior to October 1, 2013 may travel with the firearm to other states and return so long as it is not a violation in the state you are traveling to and the firearm is being transported in accordance with the law. A person may not transport an assault weapon into Maryland for target competition unless the person lawfully possesses, has a purchase order for, or applied to purchase the weapon before October 1, 2013. Federal law allows a person to transport a firearm through Maryland but not to Maryland if the firearm is not in compliance with state law.

Can I legally transport my regulated firearm to the range?

Yes, however, Maryland and Federal laws require specific conditions be met while transporting a handgun. Please refer to Maryland Annotated Code, Criminal Law, Title 4, Section 203 for a detailed account of wearing, carrying, or transporting a handgun. You may access the Maryland General Assembly website at http://mlis.state.md.us/ You can access the Federal requirements through www.atf.gov and conduct a search for “27 Code of Federal Regulations, Part 178” and then look for “Transportation of Firearms.” The basic requirement during transport is the handgun must be unloaded and in an enclosed case or enclosed holster with the ammunition separate from the handgun AND you must be transporting the handgun to or from the locations listed in the statute.

Can I legally transport firearms interstate?

Yes, under Title 18, Section 926A, of the United States Code, a person who is not prohibited from possessing, transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment. In the case the vehicle does not have a compartment separate from the driver's compartment the firearm or ammunition shall be contained in a locked compartment other than the glove compartment or console.

VEHICLE LAW

Does the Maryland State Police receive money from the citations it issues?

No. All revenue from citations goes into the general fund of Maryland. The money does not go directly to the State Police.

Do I have to stop for an unmarked car displaying red or red & blue lights?

Police vehicles must activate a siren to be an emergency vehicle and may or may not display red or blue lights. Most unmarked Maryland State Police vehicles display at least one blue flashing light. If you feel uncomfortable pulling over, acknowledge to the vehicle that you are aware that they are trying to pull you over by waving and slow down. Drive to a well lit area where people are. If you have a cell phone dial #77 and this will connect you with the nearest Maryland State Police barrack. Advise the dispatcher that you are uncomfortable with the situation and the dispatcher will assist you.

Can I have any cracks or stars in my windshield and still have it pass inspection?

It depends on where on the windshield. In the area of the sweep of the windshield wipers (critical area) then it will not pass. Contact our Automotive Safety Enforcement Section at msp.ased@maryland.gov.

What colors and types (under body, in-car, etc.) of neon lights are legal?

In Maryland you can only show white and amber lights to the front and amber and red to the rear (with the exception of a white tag light). Typically, aftermarket neon lights are not legal. Contact our Automotive Safety Enforcement Section at msp.ased@maryland.gov for further information.

What are the penalties for impaired driving in Maryland?

For the first offense $500 fine and up to 2 months imprisonment. Second offense $500 and up to 1 year imprisonment.

A Trooper is behind me with his/her lights on. What should I do?

Look in your rearview mirror to see if the trooper is motioning for you to go to a specific shoulder. If he/she is, follow the directions. Never slam on your brakes and never stop in the travel lane. Put your directional on and carefully move to the shoulder of the road. Do not get out of your car - wait for the Trooper to approach you. This is done for your safety and the safety of the Trooper.

I just moved to Maryland. When do I have to obtain an in-state driver's license and vehicle registration?

Within 60 days.

Can a person under the age of 16, who has a learner's permit from their home state, legally drive in Maryland?

No. Maryland does not recognize out-of-state permits.

Is it legal for me to use a cellular phone while driving?

No. Your phone can only be used hands-free.

How can I clear my own driving record?

You can ask for an expungement through the Motor Vehicle Administration. You can get more information at mva.maryland.gov.

I am interested in having my child safety seat inspected to make sure it was installed correctly. Does the State Police provide this service?

Yes. Please contact your closest barrack to schedule an appointment. In many counties the health department also provides this service.

What percent can windows be tinted on the vehicle?

For passenger cars, 35 percent. Windows behind the driver's seat may be tinted darker on SUV's. Tint may be tested by the Automotive Safety Enforcement Section at the Glen Burnie Motor Vehicle Administration.

Do motorcycle riders have to wear a helmet in Maryland?

Yes. The helmets must meet the standards set by the Motor Vehicle Administration. For more information contact mva.maryland.gov.

What are Maryland's legal limitations regarding vehicle width, height, length, and load extensions?

Can people legally ride in the bed of a pickup truck?

Yes. This applies to a Class E truck (pickup) with a gross vehicle weight under 7,000 pounds that is traveling not more than 25mph or is transporting an employee to or from a work site by the employer or is engaged in a farming operation. Children under 16 years of age may not ride in an unenclosed bed.

Is a front license plate required on Maryland-registered cars?

Yes. When two plates are required then one must be on the front and one must be on the rear of the vehicle. They must be mounted in the manner intended by the manufacturer (not in the rear window or secured with a metal coat hangar, etc.)

Are radar/laser detectors legal in Maryland?

Yes, in vehicles that are less than 10,000 pounds gross vehicle weight.

Is it against the law to operate a vehicle while not wearing shoes?

No.

How long can I leave a disabled vehicle along the highway?

On controlled access highways such as interstates, 24 hours. On other roadways 48 hours. If the vehicle is causing a danger or is in a traveled lane it is subject to immediate towing.

My vehicle was stored (impounded) by the State Police. How can I get it back?

Since circumstances of the storage may vary, you should contact the Barrack that stored the vehicle. They can advise you of the specific requirements to release your vehicle.

I was just issued a warning. What do I do?

Say thank you. Other than that, no action is required and warnings do not become part of your driving record.

In Maryland can I be stopped for not wearing my seatbelt if I do not commit any other violation?

Yes. In Maryland it is a primary offense (one for which you can be stopped) to operate a vehicle while not wearing a seatbelt.

Can a Trooper pull me over without using radar or laser speed measurement?

Yes. Troopers may pace a vehicle to determine a speed in addition to using radar, laser or VASCAR.

When does a traffic accident report have to be completed?

Each police department has a different policy. As a general rule: when there are injuries or when the severity of the collision is so severe that the vehicle has to be towed, an accident report must be completed.

I understand that when I get a traffic ticket, I also get "points" on my driving record. What are "points" and how does the points system work?

The point system is administered by the Motor Vehicle Administration. Traffic violations are misdemeanor crimes in Maryland and for moving violations, upon conviction you are assessed points to your driving record. When you are convicted of a traffic violation, points accumulate for a two year period. A license will be suspended when a driver accumulates 8 points and revoked when a driver accumulates 12 points.

Are radar jammers legal in Maryland?

No. They are illegal in all 50 states according to an FCC ruling.

VEHICLE OPERATION

How much can I drink and still be fit to drive?

In Maryland, if a person's blood alcohol concentration is .05 or less it shall be presumed that the person was not under the influence of alcohol and that person was not driving while impaired by alcohol.

I received a speeding ticket in Maryland and lost it? What do I do?

You can contact the District Court of Maryland and give them your name. It takes awhile for the information to be entered into the computer. If a citation is not paid, you will get a court date in the mail.

I was stopped by a trooper and my driver license, registration, or insurance card was not returned. What do I do?

Contact the barrack where the trooper works if you know that. If you were given a warning or citation, it will have the trooper's name and ID number on the bottom. The dispatcher or duty officer should be able to help you get in touch with the trooper or leave a message on their voice mail. Remember that troopers work shift work and it may be difficult for them to contact you right away.

What should I do if my car breaks down out on the highway?

Pull the vehicle onto the shoulder as far way from the traveled portion of the roadway as possible. Stay with your vehicle, raise the engine hood and activate your emergency flashers. If you have a cell phone dial #77 and this will connect you to the nearest Maryland State Police barrack.

What should I do if I see a person driving recklessly or aggressively?

Why does the Maryland State Police conduct sobriety checkpoints?

To educate and deter drunk driving.

What should I do if I witness or come upon a crash?

Pull safely off the roadway, see if anyone is injured and if you have a cell phone dial 911. Make sure that you give the dispatcher your exact location (Route number and direction of travel), your name and phone number, how many persons were injured and the severity of injury.

How do troopers test suspected impaired drivers?

Maryland state troopers use the Standard Field Sobriety Test. This is a set of tests using multitasks for the driver so the trooper can determine sobriety. These include balance tests (one leg stand and heel to toe test), testing the driver’s cognitive ability, and checking of the driver’s eyes for indications of intoxication. In addition, troopers may use preliminary breath testers which can measure a driver's blood alcohol concentration on the side of the road.

What happens if I refuse to sign a traffic ticket?

You are subject to arrest. When signing a citation you do not admit any guilt, you are advising that you will comply with the requirements of the citation (appearing in court or paying the fine).

How much over the speed limit do I have to go before I will get a ticket?

Anytime that you drive over the posted speed limit you may legally be issued a citation.

Is it against the law to operate a vehicle while not wearing shoes?

No.

What are the penalties for impaired driving in Maryland?

I got a traffic ticket and want to attend traffic safety school to get the fine reduced. How do I do that?

You can request this from the judge at your trial. He may give you probation before judgment and you will have to set up Driver Improvement Program school. This can be done at most community colleges.

I received a traffic ticket from a trooper. What do I do?

If you want to plead guilty, you can send a copy of the citation and a check made out for the fine amount to the District Court of Maryland. If you want to plead guilty and request leniency before a judge send in the white copy. If you want to plead not guilty don’t do anything and a court date will be mailed to you. The instructions are on the back of your copies of the citation.

How can a commercial vehicle driver obtain an oversize or overweight permit in Maryland?

VEHICLE EQUIPMENT

What is the maximum lift height for a vehicle? And how do you measure it?

The maximum height for Class A (passenger vehicle) is 20 inches, Class M (multipurpose) is 28 inches, Class E (pickup trucks) registered 10,000 pounds or less is 28 inches, Class E (pickup trucks) registered over 10,000 but not more than 18,000 pounds is 32 inches. How do I transfer a motor vehicle title in Maryland?

Typically all you need is the signed title, a vehicle inspection and a check for the taxes owed. You can get more information at mva.maryland.gov.

I just received a Safety Equipment Repair Order. How do I comply?

On the copy of the SERO that you received, you will see the violation for which you were cited. Those with an asterisk ( * ) may be visually inspected by a member of any police agency that participates in the SERO program. For violations without an asterisk, you must take the vehicle to a certified inspection station and they must certify that the problem was corrected. After the problem is corrected, mail the SERO to the address provided on the copy you received.

How can I tell if my window tint is legal?

On passenger cars, convertibles, and station wagons:

All windows with aftermarket (added) tint must have at least 35 percent light transmittance. Red, yellow, amber, and reflective window tint is prohibited.

On multipurpose vehicles, limousines, vans, and class “E” trucks that have a gross vehicle weight rating (GVWR) equal to or less than 10,000 pounds:

Windows on the driver and right front passenger doors with aftermarket (added) tint must have at least 35 percent light transmittance. Red, yellow, amber, and reflective tint is prohibited on these windows.

All other windows can be tinted to any degree of darkness or color.However, reflective tint is prohibited.

Post manufactures window tint is prohibited on the windshield of any vehicle below the AS1 line or 5 inches from the top of the windshield.

Can I use studded snow tires on my car?

If the owner of the vehicle registers the vehicle in Allegany, Carroll, Frederick, Garrett and Washington counties between November 1st and March 31st.

How do I obtain a title for a salvaged or self-assembled vehicle?

Through the Motor Vehicle Administration. Their website is mva.maryland.gov.

I bought a used car and need to have the Vehicle Identification Number (VIN) inspected before I can register it. How can I get a VIN inspection?

You can call your local Maryland State Police Barrack and the duty officer can help you set up an appointment.

Are blue headlights legal?

No, blue headlights are not legal. Headlights must be white in color. Any required lamp, lens, or reflector that is obscured by any object or shielded by a nontransparent material, or any headlamp equipped with aftermarket clear, tinted or screen type color is prohibited. I have a permit/CCW from my state. Is this valid in Maryland?

No. Maryland does not recognize permits/CCWs from any other state.

Can I legally transport my regulated firearm to the range?

Can a LiveScan provider that is not on this list print me?

No. They must be approved by the Dept. of Public Safety and Correctional Services.

Can a handgun instructor that is not on the list qualify me?

No. The handgun instructor must be registered with the Maryland State Police on-line registration.

I cannot get the application to download or come up on my screen?

The application is not supported by certain internet service providers. Therefore, Internet Explorer must be used for the application to download.

What number on my LiveScan receipt should I put at the top of the application?

You may leave this area blank. Send in a copy of the LiveScan receipt with the application.

How do I obtain a replacement if my Handgun Permit is lost or stolen?

You must submit a notarized letter advising the circumstances surrounding the disappearance of the permit. Submit a $10 check or money order and one (1) passport size photograph taken within the last 30 days. If you are a security guard, private detective, armored car guard or special police officer, also provide a company letter from your current employer verifying your employment.

Can the application be handwritten?

No. The application must be completed on the computer, then printed and signed. Handwritten applications will be returned as incomplete.

The on-line handgun permit application will not accept my valid email address. What do I do?

You may handwrite the email address or you can print the application out with the red banner showing. If handwriting the email address make sure it is accurate and legible.

If my handgun permit should expire before I receive my renewed handgun permit card, can I still carry a handgun?

As long as the renewal application has been received at the Handgun Permit Section at least two (2) weeks prior to the expiration date of the current handgun permit, you are still allowed to carry on the expired permit until you receive your renewed permit. If the application is returned to you for incompleteness and you resubmit it after the two (2) weeks, you will not be allowed to carry your handgun.

What documentation do I need to submit with my renewal application?

You need to submit the same documentation as when you first applied.

What is the process upon receipt of my application?

Upon receipt of the application, and all required documents and information, a review of the application packet will begin. Those applications determined to be incomplete, inaccurate and/or with purposeful omissions will be returned to the sender. A criminal investigation of the applicant and/or submitter may be initiated if false information is supplied. Returned applications are not considered received by the Licensing Division until they are returned satisfactorily completed with the necessary attachments and fees.
A background investigation will be initiated on those applications accurately submitted in their entirety. The date the background is initiated depends on the accuracy, truthfulness, and completeness of the submission. The Maryland State Police will investigate the character, reputation, and qualifications of each applicant. The State Police shall conduct a computer generated criminal history background investigation of the applicant to determine if the applicant is prohibited by State or federal law from purchasing or possessing a regulated firearm or if the applicant is engaged in the business of selling firearms for profit.
Applicants found to be prohibited by State or federal law from purchasing or possessing a regulated firearm, or is engaged in the business, the application shall be disapproved. Upon completion of the investigation, the Maryland State Police will evaluate the information provided and issue permits appropriately.

What do I do if my name or address changes?

It is the Permit holder’s responsibility to ensure the Licensing Division is notified of address or name changes in writing. There is no fee to change information maintained by the Licensing Division. E-mail notifications are not accepted and you may not receive a confirmation of receipt for change of information.
